Why Rajkot businesses choose us.

A recognisable brand name is a real commercial asset for manufacturers competing on distributor trust — registering it stops a rival unit from selling look-alike parts under a confusingly similar name.

Rajkot's manufacturing clusters at Aji and Metoda GIDC and along Bhavnagar and Gondal Road turn out diesel engines, submersible pumps, auto components, CNC and machine tools, forgings and castings, brass parts, kitchenware and imitation jewellery. The classes used most here are Class 7 for engines, pumps and machine tools, Class 12 for vehicle parts and accessories, Class 8 for hand tools, Class 6 for castings, forgings and metal hardware, and Class 21 for stainless-steel kitchenware.

These products sell through dealer and distributor networks where the brand name on the box is what a mechanic or retailer asks for by memory. That makes the name a genuine asset — and a target. Look-alike part names and near-identical logos on pump sets and engine spares are a recurring problem in this market.

A registration in the right class lets you act on it directly: a notice backed by the statutory right to sue for infringement, an injunction restraining the rival unit, and orders for delivery-up of infringing labels and marks — without first having to prove the reputation that a passing-off claim needs.

We work with auto-parts and engineering manufacturers, casting units, and machine-tool businesses in and around Rajkot. The search, the filing paperwork and any Registry correspondence can all be coordinated over call, WhatsApp and courier, without you needing to travel to our Ahmedabad office.

How it works

01 Step

Assignment Deed Drafted

We draft the assignment deed recording the transfer of ownership from the assignor to the assignee, along with a statement of case explaining the circumstances of the transfer.

02 Step

Deed Executed & Stamped

The deed is signed by both parties and stamped as per applicable stamp duty — required before it can be filed with the Registry.

03 Step

Form TM-P Filed

For a registered mark, apply promptly in Form TM-P to record title under Section 45 and Rules 75–76 with the appropriate assignment evidence. Section 45 has no general six-month filing deadline. Assignment without goodwill has a separate Section 42 advertising-directions requirement.

04 Step

Register Updated

Once the Registrar is satisfied, the Trade Marks Register is updated to show the assignee as the new registered proprietor — only after this does the new owner's title become fully enforceable against third parties.

FAQ

Frequently asked questions

Section 45 does not set a general six-month deadline for recordal. Apply promptly in Form TM-P with the appropriate evidence. The six-month period in Section 42 concerns applying for advertising directions for an assignment without goodwill; the Registrar may allow further time not exceeding three months in aggregate for that requirement.

The deed and transaction determine the claimed transfer, while the register must be updated through the appropriate recordal procedure. Section 45(4) protects a person who acquires a conflicting interest without knowledge before the recordal application is filed. Do not assume that the old recorded proprietor remains the substantive owner regardless of the deed. Apply promptly and check the transfer documents.

Yes — a trademark can be assigned "with goodwill" (transferred along with the business it's associated with) or, in most cases, "without goodwill" (transferred independently of the business), though the latter has some restrictions to prevent public confusion about the origin of goods.

The e-filing fee for recording an assignment under Section 45 is ₹9,000 per trademark, in addition to any professional fees for drafting the deed and statement of case.

No. Incorporation alone does not transfer an individual's mark to the new company or LLP. Review an appropriate assignment.

No. A name change of the same legal entity differs from a transfer to a different owner. Check the supporting records.

Send application or registration details, the current and proposed owners' legal details, the transaction terms and any signed deed already available.

No. The deed and subsequent steps should match the actual business transfer. Assignment without goodwill requires particular attention.

Potentially yes, subject to the rights transferred and an appropriate licence. Assignment transfers ownership; licensing permits use on agreed terms.

If your mark is registered in the relevant class (typically Class 7 or 12), you can send an infringement notice, apply to court for an interim injunction to stop further sales, and seek damages or an account of profits. We prepare the notice and work with your advocate if the matter goes to court.

Class 7 covers engines and motors (other than for land vehicles), pumps, machine tools and machines generally. Parts specifically for land vehicles fall in Class 12, and hand-operated tools fall in Class 8 — many Rajkot manufacturers file in more than one of these to cover their full range.

Shapes can be registered, but Section 9(3) refuses a shape that results from the nature of the goods, is necessary to obtain a technical result, or gives the goods substantial value. Most pump bodies and engine parts are shaped by what they do, so they usually fail that test. The brand name, the logo and a distinctive label or packaging are far stronger things to register. A new appearance for a product may instead be protected as a registered design under the Designs Act.

Imitation jewellery is in Class 14, the same class as precious jewellery. Non-electric kitchen utensils and containers, such as steel vessels and cookware, are in Class 21, while cutlery such as knives, forks and spoons is in Class 8, and electric kitchen machines such as mixers are in Class 7. A mark registered only in Class 21 does not cover cutlery sold under the same name, so check where each product sits before filing.

No. Applying a false trade mark to goods, and selling goods that carry one, are offences under Sections 103 and 104 of the Trade Marks Act. A police officer not below the rank of Deputy Superintendent can search and seize without a warrant, but under Section 115(4) must first obtain the Registrar's opinion on the facts. A registration certificate makes both the criminal complaint and a civil suit for infringement much easier to pursue.

Last Note

If your brand could only get one thing right, make it the trademark.

That is what we help you decide. Then we search it, file it, defend it, and keep it renewed for the next ten years — from Ahmedabad, for all of Gujarat.
