A trademark Power of Attorney (Form TM-M, authorising your agent to file and act for you) has to be stamped -- but there's no single national rate. Stamp duty is fixed by each state's own Stamp Act, so a Rajasthan filing and a Gujarat filing genuinely need different-value stamp paper. Do you also need a User Affidavit?
This is a separate document from the Power of Attorney, and a separate question from how old anything is. Under Rule 25(2) of the Trade Marks Rules, 2017, a User Affidavit is mandatory whenever your application claims any specific date of first use -- instead of filing on a "Proposed to be Used" basis. It doesn't matter whether that claimed date is a month old or ten years old: the moment you claim actual prior use, the affidavit becomes mandatory, not optional.
Deponent's name, address, designation and nationality; the class and goods/services being claimed; and the exact date of first use, in DD/MM/YYYY format.
RSSYM100 non-judicial stamp paper, same across states -- unlike the Power of Attorney, this figure doesn't vary state to state.
The affidavit alone isn't enough -- attach dated proof of use from on or before the claimed date: invoices bearing the mark, product packaging, advertisements, or website/social media records with a verifiable date. Filing a use-date claim without solid backing evidence invites an objection, not less scrutiny.
