Why Surat businesses choose us.

In a market where a sari or jewellery design name can be copied by a neighbouring unit within weeks, trademark registration is what actually lets you stop a competitor from trading on your brand's reputation — a registered mark lets you back that cease-and-desist with statutory infringement remedies, not just a passing-off claim.

Surat's textile trade runs on brand names — dress-material ranges, saree lines and lehenga collections sold through the Ring Road, Millennium and JJ markets are known to buyers by their label, not the mill behind them. The relevant classes are Class 24 for piece goods and unstitched fabric, Class 25 for readymade garments and stitched sarees, Class 26 for the laces, borders and embroidery trims, and Class 23 for yarns and threads. A stylised label design can additionally be filed as a device mark.

On the diamond and jewellery side, Class 14 covers polished diamonds, studded jewellery and the growing set of lab-grown diamond brands coming out of the Surat bourse. Exporters often register in India first to establish a priority date before filing abroad through the Madrid Protocol.

The practical value of registration here is enforcement speed: when a similar dress-material or jewellery name surfaces in Sahara Darwaja, Salabatpura or a neighbouring unit, a registered mark lets you send a cease-and-desist that actually carries statutory weight and, if needed, move for an injunction — an unregistered name still has passing-off as a fallback, but you would need to prove reputation and goodwill from scratch each time, which is slower and costlier than pointing to a registration certificate.

We work with diamond and jewellery businesses, textile and sari manufacturers, and garment exporters in and around Surat. The search, the filing paperwork and any Registry correspondence can all be coordinated over call, WhatsApp and courier, without you needing to travel to our Ahmedabad office.

How it works

01 Step

Trademark Search

We run a search across the Trademark Registry's public database to check for identical or deceptively similar marks already filed or registered in your class, before you commit to a name or logo.

02 Step

Class Selection & Online Trademark Filing

Your mark is filed as a Form TM-A application, entirely through online trademark filing on the IP India e-filing portal, under the correct Nice Classification class(es) — there are 45 classes in total, 34 for goods and 11 for services — for the goods or services you actually deal in.

03 Step

Examination & Journal Publication

The Registry examines the application on absolute grounds (Section 9 — is it generic or merely descriptive) and relative grounds (Section 11 — does it conflict with an existing mark), and if accepted, publishes it in the Trademark Journal for a four-month opposition window.

04 Step

Registration Certificate

If no opposition is filed within that window, the Registrar issues the trademark registration certificate and you gain the right to use the ® symbol.

FAQ

Frequently asked questions

The brand name and any stylised logo on the label can be registered as a wordmark and a device mark. The woven or printed pattern of the fabric itself is not a trademark — that is protected, if at all, as a registered design under the Designs Act, which is a separate filing.

Yes. With a registration in the relevant class you can issue a cease-and-desist with statutory backing and file for an injunction and damages for infringement, which is far faster than a passing-off suit. Without registration you must first prove reputation and goodwill in court before any relief.

It depends on what you sell. Sarees, lehengas and other garments are clothing in Class 25. Unstitched dress material, suit pieces and fabric sold by the metre are textile goods in Class 24. Many Surat traders sell both, and one application can cover both classes, but the government fee is charged for each class.

Class 14 covers precious stones and jewellery, so polished diamonds and diamond jewellery sold under your brand belong there. If customers know the name as your trading or retail business rather than as a mark on the goods, Class 35 covers wholesale and retail services, and many trading houses file in both. Describe the goods as you actually sell them, natural or lab-grown, rather than copying another applicant's wording.

Yes. A word in Gujarati script, or a Gujarati word written in English letters, can be registered like any other word mark. If the mark is in Gujarati script, Rule 28 of the Trade Marks Rules, 2017 requires the application to give a transliteration, a translation into English or Hindi, and the language. Either way the Registry examines the meaning: a Gujarati word that simply describes the goods meets the same Section 9 objection as its English equivalent.

Under the First Schedule of the Trade Marks Rules, 2017, the official e-filing fee is ₹4,500 per class for an individual, a DPIIT-recognised startup or a small enterprise, and ₹9,000 per class for any other applicant. Rule 2(1)(v) defines a small enterprise by the investment limit for a medium enterprise under the MSMED Act, 2006, so a company, LLP or firm can qualify on the strength of its Udyam certificate. Filing on paper costs ₹5,000 and ₹10,000 per class respectively. This is a per-class fee — three classes means three times the fee.

A trademark registration is valid for 10 years from the date of filing, and can be renewed indefinitely in further 10-year terms by filing Form TM-R.

A trademark registered with IP India is protected across the whole of India the moment it's granted — there's no separate state-level registration. Being Gujarat-based only affects which Registry office typically handles your filing (Ahmedabad falls under the Trademark Registry's jurisdiction), not the geographic scope of protection.

Last Note

If your brand could only get one thing right, make it the trademark.

That is what we help you decide. Then we search it, file it, defend it, and keep it renewed for the next ten years — from Ahmedabad, for all of Gujarat.
