Why Gandhinagar businesses choose us.
Financial and tech brands here are often building for scale from day one, and a registered trademark is frequently a checklist item for institutional partners, banks and platform onboarding.
Gandhinagar applications are examined by the Trade Marks Registry at Ahmedabad, which holds territorial jurisdiction over the whole of Gujarat from Boudhik Sampada Bhavan in Ghatlodia. In practice the 25-odd kilometres rarely matter: filing, replies and status checks are all online. Where the distance does show up is hearings, and even those are now commonly listed by video conference. Plan around the deadline, not the drive.
A large share of Gandhinagar filings now come out of GIFT City, where the business is financial or fintech and the mark belongs in Class 36. Two things catch applicants there. First, being incorporated or licensed at GIFT IFSC says nothing about trademark rights - a regulator clearing your entity name is not the Registry clearing your brand. Second, Class 36 is crowded with short, abstract, finance-flavoured names, so a mark that felt distinctive at incorporation often meets a Section 11 citation on examination.
The other cluster is the Kalol-Chhatral pharmaceutical and chemical belt in Gandhinagar district, which puts a steady stream of Class 5 and Class 1 marks through the Registry. Pharmaceutical names attract Section 11 objections more often than most sectors, because the Registry compares them for phonetic similarity against a register already dense with coined drug names built from the same stems. Getting the specification tight, and having the honest-adoption story ready, matters more here than in most classes.
We work with fintech and IT firms, GIFT City-based businesses, and government-facing consultancies in and around Gandhinagar. The search, the filing paperwork and any Registry correspondence can all be coordinated over call, WhatsApp and courier, without you needing to travel to our Ahmedabad office.
How it works
Assignment Deed Drafted
We draft the assignment deed recording the transfer of ownership from the assignor to the assignee, along with a statement of case explaining the circumstances of the transfer.
Deed Executed & Stamped
The deed is signed by both parties and stamped as per applicable stamp duty — required before it can be filed with the Registry.
Form TM-P Filed
For a registered mark, apply promptly in Form TM-P to record title under Section 45 and Rules 75–76 with the appropriate assignment evidence. Section 45 has no general six-month filing deadline. Assignment without goodwill has a separate Section 42 advertising-directions requirement.
Register Updated
Once the Registrar is satisfied, the Trade Marks Register is updated to show the assignee as the new registered proprietor — only after this does the new owner's title become fully enforceable against third parties.
Documents Required
Checklist- Original trademark registration certificate / application details
- Signed and stamped assignment deed
- PAN and ID proof of both assignor and assignee
- Board resolution or authorisation letter, if either party is a company or LLP
- Statement of case explaining the nature of the assignment

Section 45 does not set a general six-month deadline for recordal. Apply promptly in Form TM-P with the appropriate evidence. The six-month period in Section 42 concerns applying for advertising directions for an assignment without goodwill; the Registrar may allow further time not exceeding three months in aggregate for that requirement.
The deed and transaction determine the claimed transfer, while the register must be updated through the appropriate recordal procedure. Section 45(4) protects a person who acquires a conflicting interest without knowledge before the recordal application is filed. Do not assume that the old recorded proprietor remains the substantive owner regardless of the deed. Apply promptly and check the transfer documents.
Yes — a trademark can be assigned "with goodwill" (transferred along with the business it's associated with) or, in most cases, "without goodwill" (transferred independently of the business), though the latter has some restrictions to prevent public confusion about the origin of goods.
The e-filing fee for recording an assignment under Section 45 is ₹9,000 per trademark, in addition to any professional fees for drafting the deed and statement of case.
No. Incorporation alone does not transfer an individual's mark to the new company or LLP. Review an appropriate assignment.
No. A name change of the same legal entity differs from a transfer to a different owner. Check the supporting records.
Send application or registration details, the current and proposed owners' legal details, the transaction terms and any signed deed already available.
No. The deed and subsequent steps should match the actual business transfer. Assignment without goodwill requires particular attention.
Potentially yes, subject to the rights transferred and an appropriate licence. Assignment transfers ownership; licensing permits use on agreed terms.
No. Company incorporation, an IFSCA licence and a trademark are three separate things. Incorporation stops another company being registered with a confusingly similar company name; it does not give you the right to stop a competitor using that name as a brand, and it is not a defence if someone else already holds the mark. If the name is what customers recognise you by, it needs its own trademark application in the relevant class - usually Class 36 for financial services, often alongside Class 42 if you also supply the software.
No. Filing is done online through the IP India portal, and the application is allotted to the Ahmedabad registry automatically because that office covers Gujarat. You would only deal with Ahmedabad in person if a hearing is listed and is not held by video conference. Being outside Ahmedabad does not slow the application down or change the fees.
Usually more than one. Class 36 covers financial services such as payments, lending, insurance and fund management. Class 9 covers downloadable software and mobile apps, and Class 42 covers software as a service and software development. A fintech whose customers know it by its app name typically files in Class 36 and in Class 9 or Class 42, depending on how the product is delivered.
Yes. Section 46 of the Trade Marks Act allows an application where a company is about to be formed and the applicant intends to assign the mark to it, so a founder can file now and assign the mark once the company exists. There is a deadline: under Section 46(4) and Rule 85 of the Trade Marks Rules, 2017, the company must be recorded as owner within six months of the registration being advertised in the Trade Marks Journal (the Registrar may extend this by up to six months), or the registration ceases to have effect. Filing early fixes your filing date. The assignment needs a deed, stamp duty and a Form TM-P filing.
Either can apply in India. A foreign parent with no place of business in India must give an address for service in India, and can then license the mark to the Indian entity in writing. If the GIFT City entity applies, its application is handled by the Ahmedabad office. Decide before filing: moving the mark later means an assignment deed, stamp duty and a Form TM-P filing.
