Trademark Status: Formalities Chk Pass — Meaning and Next Steps
Short answer: "Formalities Chk Pass" means the Trade Marks Registry has checked the application's formal requirements, such as the form, fee, applicant details, mark representation and supporting documents, and found nothing that stops it moving towards examination. It is a positive step but not an acceptance: the examiner has not yet searched earlier marks or decided whether the mark can be registered.
Why your application shows this status
IP India publishes no formal definition, but its draft Manual of Trade Marks Practice and Procedure describes formality requirements that decide whether an application can "move towards examination". This status shows no formal deficiency is holding the application back at that stage. It sits between filing ("New Application", plus "Send to Vienna Codification" for logo marks) and examination. Substantive examination under Section 18 and Rule 33 comes later: the examiner searches earlier marks and considers absolute and relative grounds for refusal. The draft Manual says applications are allotted to examiners in order of filing date and time; expedited processing under Rule 34 is the route to faster examination.

What happens next
- The application is allotted to an examiner, which shows as "Marked for Exam".
- The examiner examines it under the Act and searches earlier trade marks for identical or similar marks (Rule 33(1)).
- The result is either acceptance and advertisement in the Trade Marks Journal, or an examination report listing objections, which can still include formality requirements.
- A reply to an examination report is due within one month from the date of receipt (Rule 33(4)); after advertisement, anyone may oppose within four months (Section 21(1) and Rule 42).
- The wait before examination depends on Registry workload; no period is fixed by the Act or Rules.
What to do now
- No filing is needed because of this status.
- Keep watching the status and the email address given in the application, since the reply to an examination report is due within one month from receipt (Rule 33(4)).
- If use of the mark was claimed, keep dated evidence of use ready (invoices, advertisements, website captures) in case the examiner raises an objection that such evidence can answer.
- Check the e-register details are still correct; errors can be corrected on Form TM-M under Rule 37.
- If faster handling is needed, consider a request for expedited processing on Form TM-M under Rule 34 (prescribed fee; the Registrar may limit the number of requests).
Common mistakes
- Treating "Pass" as acceptance or registration, or starting to use ®; Section 107 prohibits falsely representing a mark as registered.
- Assuming the mark has cleared a search for similar earlier marks; that search happens at examination.
- Assuming no formality point can come up again; the examination report can still list formality requirements.
- Leaving the email address given in the application unmonitored; a missed one-month reply can lead the Registrar to treat the application as abandoned (Rule 33(4)).
