Which applicants come under Ahmedabad
The Ahmedabad office covers Gujarat, Rajasthan, and the union territory of Dadra and Nagar Haveli and Daman and Diu.
Jurisdiction is decided by the applicant's principal place of business in India, not by where the brand is used, where the goods are sold, or where the agent sits. A business headquartered in Ahmedabad, Surat, Rajkot, Vadodara, Jamnagar or Gandhinagar comes under this office. So does a business headquartered in Jaipur or Jodhpur.
Where an applicant has no place of business in India, jurisdiction follows the address for service in India that the applicant is required to give.
You do not file at the office
This is the point most people get wrong. Trade mark filing in India is online and centralised. You do not visit the Ahmedabad office to submit an application, and there is no counter advantage to being local.
What the jurisdiction actually determines is which office your file sits with afterwards: which office examines it, which office issues the examination report, and which office holds any hearing.
The practical consequence is that your choice of agent is not constrained by geography. An agent anywhere in India can act for an applicant in any jurisdiction, because the work is done through the same electronic system regardless of where the agent is based.
Hearings
Hearings before the Registry are no longer necessarily in person. Rule 115(1) of the Trade Marks Rules, 2017 permits hearings to be held through video conferencing or other audio-visual means, and in practice a large share of show cause and opposition hearings are now conducted that way.
That removes what used to be the strongest argument for using a local agent. Attending a hearing for an Ahmedabad-jurisdiction matter no longer requires anyone to be in Ahmedabad.
What happens at this office
Once an application is filed, the Ahmedabad office carries out the formalities check, examines the mark on absolute and relative grounds, and issues the examination report. If objections are raised, the reply is filed against this office and any resulting show cause hearing is listed here.
If the mark is advertised in the Trade Marks Journal and someone files a notice of opposition, the opposition proceedings are also conducted under this office, including the exchange of evidence and the final hearing.
