How to Choose a Trademark Consultant in Ahmedabad
Registering a trademark in India is not just a form-filling job. Roughly one in three applications draws an Examination Report objection, and a weak reply — or no reply — can cost you the mark. Who prepares and prosecutes your application matters. Here's how to choose well in Ahmedabad.
1. Verify the credential, not just the label
Anyone can call themselves a "trademark consultant." Two credentials actually matter:
- Registered Trademark Agent — a person registered with the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM), holding a registration number. A Trademark Agent can file, prosecute, reply to Examination Reports, and appear in hearings before the Registry.
- Advocate — enrolled with a State Bar Council. An advocate is needed for court proceedings (infringement suits, appeals before the High Court).
Ask directly: "Are you a Registered Trademark Agent? What is your registration number?" For routine registration and prosecution, a Registered Trademark Agent is what you need. For litigation, you want an advocate involved as well.
2. Ask exactly what is included
"Trademark registration" can mean very different scopes. Before you commit, get in writing whether the quote covers:
- A clearance search before filing (not just an availability check on a free tool).
- Form TM-A filing — and confirmation that the government receipt will be in your name.
- Examination Report reply — if a Section 9 or Section 11 objection is raised, is drafting and filing the reply included, or billed separately?
- Show-cause hearing — will they attend the hearing (in person or by video conference) before the Trade Marks Registry, Ahmedabad?
- Journal monitoring and opposition — who watches for a third-party opposition after publication?
- Renewal tracking — will they remind you before the 10-year renewal date?
A cheap "filing only" quote that excludes the objection stage often costs more in the end.
3. Know the government fee so you can read the quote
The government fee is fixed by law and is the same for every consultant:
- ₹4,500 per class — individuals, DPIIT-recognised startups, and MSMEs with a valid Udyam certificate.
- ₹9,000 per class — companies, LLPs, partnership firms, and other applicants.

4. Check local presence and Registry familiarity
The Trade Marks Registry office for Gujarat is in Ahmedabad. A consultant who regularly files from Ahmedabad and attends hearings there will know the local examiners' tendencies and can appear on short notice. Ask how many hearings they have attended at the Ahmedabad Registry.
5. Judge responsiveness before you pay
You will need this person over 12–24 months — through examination, possibly a hearing, then renewal in 10 years. Send one detailed question before engaging and see how fast and how clearly they answer.
Red flags
- No Trademark Agent registration number when asked.
- A "guaranteed registration" promise — no one can guarantee the Registry's decision.
- An all-in price below the statutory government fee for your applicant type.
- No written scope — you can't tell whether the objection stage and hearing are included.
- Pressure to file immediately in many classes without a search or a class-by-class rationale.
A practical checklist
Before you hire, you should be able to answer yes to all of these:
- They are a Registered Trademark Agent and gave me their registration number.
- I have a written scope covering search, filing, Examination Report reply, and hearing.
- The government fee (₹4,500 or ₹9,000 per class) is stated separately and the receipt will be in my name.
- They confirmed the class or classes for my goods or services and explained why.
- They responded clearly and quickly to my first question.
