What a notice of opposition does
An opposition asks the Registry to refuse an advertised trademark application for the stated goods or services. The opponent needs particular facts and legally applicable grounds, rather than a list of every possible section. This is a supporting statement for the prescribed Form TM-O. Check the Journal advertisement date, the opponent’s actual rights and the scope opposed before preparing the form. Separate unsupported allegations from facts that can be proved.
Filing period and procedure
Notice of opposition: prescribed Form TM-O within four months from Journal advertisement or re-advertisement, under Rule 42. Verify the correct advertisement and filing record.
