How to answer a well-known mark or earlier-rights citation

A well-known mark can be cited as an earlier trade mark under Section 11(1) for identical or similar goods or services, or under Section 11(2) where the marks are identical or similar, the goods or services are not similar, and use of the later mark without due cause would take unfair advantage of, or be detrimental to, the earlier mark's distinctive character or repute. Section 11(3) covers passing-off and copyright rights. Section 11(5) states that registration is not refused on the Section 11(2) or 11(3) grounds unless the earlier proprietor raises them in opposition, but Section 11(10) also directs the Registrar to protect well-known marks. Verify the claimed status and answer each element on its merits.

Filing period and procedure

Respond within the Rule 33(4) period: one month from receipt of the examination report. If the earlier proprietor later raises the same ground in an opposition, answer it in the counterstatement and evidence stages.

Before you prepare the draft

Facts to confirm

  • Exact sub-section of Section 11 cited and the right relied upon
  • Basis of claimed well-known status: Registrar's list, court decision or other record, with its date and goods/services
  • Applicant's filing date, any priority date and use basis
  • When and why the applicant adopted the mark, and when it learned of the cited mark

Evidence to keep ready

  • Official extract of the well-known list entry or copy of the determination relied upon
  • Full representations of both marks and the cited goods/services
  • Dated adoption records, such as design files, search reports and earliest use documents
  • Ownership records for any artwork, and any consent actually obtained

Check before filing

Check whether the cited mark is actually on the Registrar's list of well-known trademarks or the subject of a court determination, and for what goods or services. Under Section 11(8), the Registrar must treat a mark that a court or the Registrar has already determined to be well known in at least one relevant section of the public in India as well known, so disputing that status needs evidence, not denial.

Section 11(5) is a procedural point, not a substitute for a merits answer; address similarities as well as differences. Section 11(1) is expressly subject to Section 12, but Section 11(2) is not, and Section 12 refers to the same or similar goods or services, so do not rely on honest concurrent use alone to answer a Section 11(2) citation.

This is an original drafting framework, not an official statutory form or an assurance of acceptance. Match the notice, application, evidence and service dates; use the prescribed form and complete the applicable filing, service and execution requirements.
