The Issue
When a party challenges the validity of a registered mark during an infringement suit, which forum decides validity and what procedure must be followed?
The Rule in Simple Language
The statutory rectification forum decides registration validity. When the applicable suit-linked procedure requires the civil court to consider a prima facie tenable challenge and frame an issue, that step matters. Ignoring the required follow-up can lead to abandonment of the validity plea.
The Supreme Court explained that this procedure is not an application for the civil court's permission or leave. The judgment distinguishes independent rectification proceedings from challenges connected to an infringement suit.
Apply the Current Law
The judgment discussed the earlier legislation and the IPAB-era framework. Current Sections 124 and 125 refer to the High Court following the 2021 changes.
• Check whether rectification proceedings are already pending: Section 124 contains a stay branch for that situation.
• If none are pending, check the applicable prima facie-tenability, issue-framing and application procedure.
• Record the court's order and every filing date. Obtain advice on the correct forum and deadline.
Important Limit
Do not describe every rectification application as requiring civil-court permission. The procedure depends on whether an infringement suit and the statutory conditions are present. This case is about challenging registration validity, not replying to an ordinary examination objection.
